Welcome to WhichCopy.
These Terms of Service ("Terms") govern your access to and use of the website whichcopy.com, and all related software, tools, features, and services (collectively, the "Service") operated by WhichCopy ("WhichCopy", "we", "us", or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
Company Information
WhichCopy is a product operated by Zero To Build LLC, an Oregon limited liability company.
References to "WhichCopy," "we," "us," or "our" refer to Zero To Build LLC.
1. Description of the Service
WhichCopy provides tools that enable users to:
- Retrieve and render publicly accessible web pages
- Generate AI-assisted copy variations
- Run A/B or multivariate messaging tests
- Measure engagement and click behavior
- Analyze messaging performance
WhichCopy tests messaging only. We do not host, replace, or operate your website's backend systems or transaction flows.
Usage Limits
The Service operates under tiered usage limits:
- Free: 1 AI generation, 1 page scrape per month
- Pro: 20 AI generations, 20 page scrapes per month
- Pro+: 50 AI generations, 50 page scrapes per month
We reserve the right to modify limits or introduce new tiers. Current limits are displayed at whichcopy.com/pricing.
Exceeding limits will prevent further use until the next billing period or until you upgrade your plan.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements to use the Service.
3. Account Responsibility
You agree to:
- Provide accurate information
- Maintain the security of your login credentials
- Accept responsibility for all activity under your account
WhichCopy is not liable for losses resulting from unauthorized account access.
4. Website Ownership and Authorization
When submitting a website URL or content to WhichCopy, you represent and warrant that:
- You own the website, or
- You have written permission from the owner to test and analyze it
You grant WhichCopy permission to:
- Retrieve publicly accessible HTML and assets
- Store page content
- Modify copy for testing purposes
- Serve experimental variants
- Measure visitor interactions and engagement
Prohibited Uses
You may not use WhichCopy to:
- Scrape or clone websites without authorization
- Test websites containing illegal, adult, or harmful content
- Violate robots.txt or terms of service of scraped websites
- Circumvent paywalls, authentication, or access controls
- Impersonate or mislead visitors
You are solely responsible for compliance with all applicable laws, website terms of service, and third-party intellectual property rights.
WhichCopy reserves the right to refuse service or remove content that violates these terms.
5. Service Availability
The Service is provided on an "as is" and "as available" basis.
WhichCopy does not guarantee:
- Uninterrupted availability
- Error-free operation
- Perfect scraping or rendering
- Exact visual replication of websites
- Compatibility with all technologies or frameworks
We may modify, suspend, or discontinue any part of the Service at any time without notice.
We may perform scheduled maintenance with or without advance notice. We will attempt to minimize disruption but cannot guarantee zero downtime.
WhichCopy is designed to test messaging and copy performance on marketing and landing pages. While we make a best-effort attempt to preserve page structure and usability, certain interactive elements (such as animations, modals, tabs, carousels, or dynamic components) may not function identically within test previews.
These limitations do not affect your live website and do not impact the validity of messaging or copy performance tests.
6. AI-Generated Content
WhichCopy uses automated systems and artificial intelligence to generate or modify copy.
You acknowledge that:
- AI output may be inaccurate or incomplete
- AI may generate incorrect or misleading content
- All generated content must be reviewed before use
You are solely responsible for approving and publishing any AI-generated content. WhichCopy is not liable for damages resulting from AI output.
7. Analytics and Tracking
To provide testing and reporting, WhichCopy may:
- Assign visitors to variants
- Track page views
- Track clicks and engagement events
- Store anonymized usage data

You are responsible for providing any disclosures or consent required by applicable privacy laws (including GDPR or CCPA) to visitors of your test pages.
WhichCopy does not intentionally collect personally identifiable visitor information.
8. Acceptable Use
You may not use the Service to:
- Violate any law or regulation
- Infringe intellectual property rights
- Scrape restricted or private content
- Test websites without authorization
- Distribute malware or harmful code
- Spam or abuse the platform
- Reverse engineer or disrupt the Service
WhichCopy may suspend or terminate accounts that violate these rules.
9. Payments and Subscriptions
Certain features may require payment.
By subscribing, you agree that:
- Payments are processed by third-party providers such as Stripe
- Subscriptions may renew automatically unless canceled
- You authorize recurring charges
- You are responsible for applicable taxes
Refund Policy
If you are unsatisfied with your first paid subscription, you may request a full refund within 7 days of your initial payment. After 7 days, all payments are final.
To request a refund, contact hello@whichcopy.com with your account email and reason for the refund request.
Subsequent subscriptions and renewals are non-refundable.
Cancellation
You may cancel your subscription at any time via the Settings page. Cancellation takes effect at the end of your current billing period. You will retain access until that time.
Cancellation prevents future charges but does not retroactively refund payments already made.
10. Intellectual Property
WhichCopy retains all rights to the Service, including its software, design, technology, and branding.
You retain ownership of your website content and copy. You grant WhichCopy a limited license to process and display your content solely to operate the Service.
11. Third-Party Services
The Service may rely on third-party providers, including hosting services, analytics tools, payment processors, and AI providers.
WhichCopy is not responsible for third-party services, outages, or failures.
12. No Guarantees or Business Results
WhichCopy does not guarantee:
- Increased conversions
- Increased revenue
- Improved performance
- Business success
All testing results are informational only. You assume all business risk associated with implementing changes.
13. Limitation of Liability
To the fullest extent permitted by law, WhichCopy shall not be liable for:
- Lost revenue or profits
- Lost data
- Business interruption
- Indirect, incidental, or consequential damages
- Damages arising from AI-generated content
- Website malfunctions or third-party failures
WhichCopy's total liability for any claim shall not exceed the amount paid by you to WhichCopy in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless WhichCopy and its operators from any claims, damages, liabilities, or expenses arising from:
- Your use of the Service
- Your website or content
- Your testing practices
- Your violation of these Terms or applicable law
15. Termination
WhichCopy may suspend or terminate your access at any time for violations of these Terms or misuse of the Service.
Upon termination:
- Your access to the Service will be immediately revoked
- All active tests will be deactivated
- Your data will be retained for 30 days, then permanently deleted
- No refunds will be issued for prepaid subscription time
You may terminate your account at any time via the Settings page. Cancellation prevents future charges but does not refund current subscription periods.

16. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
Material changes will be communicated via email or a notice on the website.
17. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Oregon.

19. Copyright and DMCA
If you believe content on WhichCopy infringes your copyright, send a notice to:
WhichCopy acts as a service provider and does not independently verify the ownership of user-submitted content.

Subject: DMCA Takedown Request
Include:
- Identification of the copyrighted work
- Identification of the infringing material (URL of WhichCopy test)
- Your contact information
- A statement that you have a good faith belief the use is unauthorized
- A statement that the information is accurate and you are authorized to act
- Your physical or electronic signature
We will investigate and remove infringing content where appropriate.
Counter-Notice: If you believe content was removed in error or misidentification, you may submit a counter-notice to the same email address. Counter-notices must comply with applicable legal requirements.
